Training


Employers have a duty to maintain discipline in the workplace. The main purpose of discipline in the employment context is to correct behaviour and to ensure that employees become valuable and contributing members of the workforce. However, the exercise by employers of their duty to prescribe rules and to impose discipline is often challenged by individual employees and trade unions representing them at the CCMA or Bargaining Council.
These disputes referred to the CCMA or Bargaining Council can be costly to companies due to the compensation awards associated with unfair dismissals and also due to the time that companies spend on dealing with these disputes. It is therefore imperative that HOD’s, managers and supervisors know what their rights, duties and obligations are in respect of the South African Labour Laws when dealing with employees who commit misconduct.
I provide training to companies on how to effectively maintain discipline in the workplace in line with the principles of fairness as envisaged by the LRA. The training is aimed at those supervisory employees who deal with misconduct from their subordinates on a day-to-day basis and act as Initiators at disciplinary hearings. The training consists of 5 modules i.e. the disciplinary framework, investigating misconduct, preparing for the disciplinary hearing, presenting evidence at the hearing and the principles relating to the CCMA/Bargaining Council. The training is non-accredited and includes training material consisting of manuals for classroom-type facilitation and presentations for interactive online facilitation.
